Terms and Conditions of Service

Please read these terms carefully. By confirming a booking, you, the Customer, agree to the following terms, which govern the entire relationship with Star Way Car Carrier.

Our Commitment and Your Responsibility

Welcome to Star Way Car Carrier. We specialize in secure vehicle relocation. This document outlines the agreement between you (the "Customer") and Star Way Car Carrier (the "Carrier" or "SWCC"). Our goal is scratch-free transit; these terms ensure that the logistics and legal responsibilities are clearly understood by both parties.

1. Booking, Pricing, and Payment Terms (The Money Clause)

  • **Quote Validity:** All quotes are valid for a maximum period of **7 days** only and are subject to change based on fuel price fluctuations, toll revisions, and vehicle dimensions confirmed upon inspection.
  • **Payment Structure:** The Customer must pay a minimum of **50% of the total quote** as an advance at the time of booking confirmation. The remaining **50% balance payment** is strictly due and must be cleared *before* the vehicle is unloaded at the destination.
  • **Non-Payment:** Failure to clear the balance payment before delivery will result in the vehicle being held at the nearest secure yard. The Customer shall be liable for all demurrage and storage charges (**₹1000 per day**) until full payment is received. SWCC is not responsible for any delay caused by non-payment.
  • **Cancellation:** All advance payments are strictly **non-refundable** if the cancellation request is received within 72 hours of the scheduled pickup time.

2. Vehicle Condition and Pre-Transit Inspection (The Liability Firewall)

  • **Inspection Report is Final:** The Customer must be present during the **8-Point Pre-Inspection Checklist** performed by the Carrier's representative. The signed Condition Report is the sole binding evidence of the vehicle's state prior to loading. Any claim for damages *must* refer to pre-existing conditions noted on this report.
  • **Fuel Requirement:** The vehicle must contain no more than **5 liters of fuel** upon pickup. Excess fuel is a safety risk and may lead to pickup refusal or a surcharge.
  • **Personal Items:** The Customer SHALL NOT leave any personal belongings, valuables, documents, or accessories inside the vehicle. Insurance coverage is strictly for the vehicle itself and **does not cover internal contents**. SWCC assumes zero liability for loss or damage to any item left inside the car.
  • **Operational Condition:** The vehicle must be in working, drivable condition unless explicitly agreed upon for non-running vehicle transport, which incurs a mandatory surcharge.

3. Transit, Insurance, and Limitation of Liability (The Core Protection for SWCC)

  • **Maximum Liability Cap:** The Carrier's liability for any damage is strictly limited to the coverage amount specified in the transit insurance policy purchased by the Customer. **In no event shall SWCC's liability exceed the cost of the repair/replacement of the damaged part, or the maximum insurance declared value, whichever is lower.**
  • **Excluded Damages:** SWCC is **NOT liable** for damage caused by:
    • Acts of God (natural disasters, severe weather).
    • Normal wear and tear, fluid leaks, mechanical or electrical faults that occur during transit.
    • Damage to the undercarriage, exhaust system, or suspension unless caused by loading/unloading negligence (which must be reported immediately).
    • Damage to antennas, spoilers, accessories, or customized parts that detach during transit.
  • **GPS Tracking Disclaimer:** The GPS tracking link is provided as a courtesy. While highly reliable, SWCC is not liable for service interruption or tracking inaccuracies caused by network failure or technical issues.
  • **Keys and Driving:** The vehicle keys are sealed and used only minimally for loading/unloading. Any mileage increase over **25 km** during transit must be reported and verified upon delivery.

4. Documentation and RTO Compliance (The Legal Burden is Yours)

  • **Customer Sole Responsibility:** The Customer is solely responsible for providing all necessary, valid, and authentic documentation, including the RC, valid Insurance, and PUC.
  • **Transit Delays due to Documentation:** Any delay, penalty, or confiscation of the vehicle or carrier resulting from invalid, incomplete, or fraudulent documentation provided by the Customer shall be the **sole financial liability of the Customer**. This includes all fines and carrier demurrage charges incurred.
  • **RTO & State Taxes:** The Customer is responsible for any applicable state road taxes or RTO charges due at the destination state. SWCC may facilitate payment but is not the ultimate payer.

5. Delivery, Claims, and Dispute Resolution (The Final Handshake)

  • **Immediate Inspection on Delivery:** The Customer or their authorized receiver **MUST** conduct a thorough inspection of the vehicle *before* signing the final Delivery Receipt.
  • **Damage Claims Window:** Any claim for new damage **MUST** be noted on the Delivery Receipt at the time of unloading and verified against the initial Pre-Inspection Report. Damage claims reported **after** the Delivery Receipt has been signed and the carrier has departed are considered **invalid and shall be rejected by SWCC.**
  • **Estimated Time of Arrival (ETA):** All ETAs are estimates only. SWCC shall not be held liable for delays caused by traffic congestion, weather events, political disturbances, RTO checking, or force majeure events.
  • **Governing Law:** This Agreement shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with this service shall be subject to the exclusive jurisdiction of the courts in **[Your Jurisdiction City, e.g., New Delhi]**.
